Terms & Conditions

These are the terms and conditions of MaiDot, Lda., NIF 510815340 and legal headquarters at Rua de São Salvador, 42, 9760-541 Praia da Vitória, Terceira Ilha, Açores, hereinafter referred to as MaiDot. Use and access to the pages of MaiDot existing on the internet obeys the general legislation in force, the set of particular rules of the company and the group, as documented. The access and use of these presupposes, therefore, the acceptance of the terms and conditions.

The user who enters his data in any form on the MaiDot page, authorizes it, automatically and freely, to integrate such information in his database. Such information is duly clearly explicit in each of the existing forms, for absolute transparency in the light of the GDPR, and you can at any time request the deletion of all your data by sending an email to geral@maidot.pt or letter. registered to Rua de São Salvador, 42, 9760-541 Praia da Vitória, Terceira Ilha, Açores.

MaiDot undertakes never to give the information collected to third parties and declines any responsibility if there is any abuse by third parties who have illegitimate access to it. Also in the light of the GDPR, as soon as any information leak or security breach that may compromise personal data is detected, MaiDot will try to inform potential victims of such leak, through the email addresses associated with each account / project that may have been affected.

MaiDot guarantees all users access to all files where their data is located so that the information previously provided is modified or deleted. Despite its headquarters in the Açores, MaiDot has a delegation on the continent, in Lisbon; and, regardless of the location / country of the user’s access, any type of legal action that is instituted must comply with Portuguese law and take place in the Lisbon District Court.

MaiDot reserves all rights to the information, data, images, or other content contained on its internet pages. The use, reproduction, copying, or total or partial disclosure of such content, whatever the purpose and the means (s) used, is expressly prohibited, without prior authorization from MaiDot. The copyright of the information and tools contained in the MaiDot pages is your property or comes from a license to use. Access to these does not, under any circumstances, imply authorization for their reproduction and / or distribution without MaiDot’s prior written consent.

The data, information, text, graphics or links (links) are made available on its website for information purposes only, MaiDot is not responsible for its integrity, accuracy, security or credibility. MaiDot will not be responsible for any damage, direct or indirect, resulting from the use of the information contained on its Internet pages.

The consultation of the information available on the pages is totally free for the users and the simple access to it does not create any commercial link between the users and MaiDot. The professional information available on the pages has the sole purpose of making known its methodologies and areas of intervention and allowing the user to see some of the potentials and benefits that may come to him from using the services provided by MaiDot. The information provided should never be considered or used as a substitute for professional technical advice.

Accordingly, users before making any decision or taking any action, should contact MaiDot, which studies, on a case-by-case basis, its special features. MaiDot also reserves the right to change the information contained on its pages or the respective settings and presentations, without prior notice and at any time. MaiDot does not assume any form of commitment regarding the updating of the information and services presented on its pages.

All content and images on this website are protected by copyright © by MaiDot or its authors. All rights are reserved. It is absolutely forbidden to copy, edit, publish, commercialize or reproduce the contents and images of this website without the express authorization of MaiDot. MaiDot’s work and images are not in the public domain.

Payments

Payments can be made via Paypal, MB, bank transfer, deposit, check or cash. When making the payment, the customer demonstrates agreement with these conditions and all the specific conditions of each project or proposal presented.

All projects imply a first deposit to be made before the start date of the same and in a percentage to be agreed, being as a rule never less than 20% of the total cost of the project. This payment will indicate the award and acceptance of the Project Specific Terms and Conditions (indicated in the document prepared for each client), as well as these terms, and whose value is non-refundable.

All projects are structured in phases (indicated in the Specific Terms and Conditions of your Project or Proposal). For each phase, a part of the total amount to be paid will be defined. For each phase completed, the client must pay the amount of work done in that phase in accordance with the terms and conditions specific to his project or proposal.

Refunds

MaiDot does not issue refunds. In case you decide to cancel your project, you will lose your award deposit and / or other payments related to the project phases already made.

Cancellations

Cancellations, in the case of projects, can be agreed between the parties but any type of contract already existing between the parties always prevails. When it comes to web hosting services, the cancellation notice of non-renewal must be carried out within 30 days prior the renewal date, being automatically renewed for the same period as the previous one if there is no written communication.

Budgets and Proposals

The budgets and conditions for each project are valid for a period of 30 days. If the client has not yet scheduled the start of his project after that time, a new contact will be necessary to study a new proposal for conditions and budget.

Defaults

Unless otherwise specified in any contract and / or proposal, they must be governed by the following points:

  • Failure to settle the entire value of the project, implies the non-delivery of part or all of the contractual development, and the rights always remain in the entirety of MaiDot;
  • Failure to complete any of the phases implies the immediate suspension of all works;
  • Failure to comply with the agreed payment phases implies, after 30 days, a charge of € 100 for each day of default.

Revisions

The number of revisions to be made during the course of the project and before its delivery is defined on a case-by-case basis. Once the project is completed and delivered, subsequent revisions and editions are charged separately.

Copyright

All product of Design, Graphic Design or Web Design work carried out by MaiDot, unless otherwise indicated and the necessary procedures for the assignment of Copyright are carried out, is protected under Portuguese and international Copyright Law being owned by MaiDot.

Upon final payment of the total amount agreed, each customer will have the rights to use the final elements created by the respective project developed.

Technical Support / Consulting

For web projects, unless otherwise defined in the Specific Terms and Conditions of your Project or Proposal, we provide 7 days of technical support after delivery of the project. Please check your work and / or website carefully and send us an email to geral@maidot.pt indicating any questions that arise in relation to this, within these 7 days.

After this deadline, if you need help, for example, to install an extension on the site or if you have misconfigured something on your site, if you want to change or add information to a design, etc., we can always help. Tell us what you need to do in relation to any type of maintenance or consultancy service. This service is charged separately and suitable for the work to be performed.

In relation to other types of technical support and consultancy to projects that are not specifically web (eg Design adaptations, guidelines for media products, etc.), you can also contact us indicating what needs to be done. This service is also charged separately and suitable for the work to be performed.

The personal treatment of the data provided, as well as the remote access to one or more electronic devices of the customers, is done with the installation of a remote assistance software, with the due consent on the part of the customer, who is responsible for performing the same installation and must always pay attention to the specific terms and conditions of that software.

MaiDot guarantees total confidentiality when performing these same remote accesses, however excluding any type of vulnerability that may exist in the software used, since these are not held by MaiDot. MaiDot does not store any remote access data nor does it create any type of procedure for repeat access without the explicit consent of the client, and with each new access, new data will always be requested in order to make the connection.

Customer support, whether remote (telephone or virtual) or face-to-face (cost per km), has different values based on the type of agreement that exists between the customer and MaiDot (ex: monthly contract that includes assistance on different topics, such as setting up an email on a computer). For all other customers for which there is no monthly agreement, the table fee will be applied, which you can consult with MaiDot at any time.

Confidentiality

All correspondence and documents provided will be treated as confidential between the client and MaiDot, unless consent has been given otherwise by both parties involved.

Communication

MaiDot is always available to satisfy the needs of its customers, namely in communication, in order to facilitate and streamline contact, clarify doubts and the like.

As such, this communication can take place via face-to-face, telephone, email, other electronic means or letter.

Response times

The working hours are, on working days, from 9 am to 6 pm (UTC / GMT +00: 00). If the support request made by the Customer is reported at a different time than the established one, you must wait until the beginning of the next business hour (business day) to start counting the response time.

The customer support model assigns three levels of priority to each and every event reported:

  1. Urgent: System completely unavailable. Access to the site by end users is impossible.
  2. High: Error that occurs to the vast majority of users and that makes normal website usability impossible.
  3. Medium: Error that occurs only to a limited set of users or that happens to all users but only for a specific feature.
  4. Low: All requests with the exception of requests that fall within one of the levels of occurrence described above (urgent, high, medium).

The response time for each event level is:

  1. Urgent: 4 hours
  2. High: 8 hours
  3. Medium: 24 hours
  4. Low: 48 hours (with the exception of evolutionary developments that must be combined upon availability of both parties)

In very specific cases, MaiDot also has an “Emergency” level with 1 hour of response, suitable only for a very specific situation and which may call into question something of great impact (be it financial or otherwise).

The response times shown are the start times for resolving issues. If the defined response time is not met, MaiDot will not charge the support hours used to resolve the respective support request.

Competent Forum

In the event of a dispute, in the interpretation or application of these conditions, the jurisdiction of the district of Lisbon is competent, with express waiver of any other.
